Dipanshi And Another Vs State Of U.P. And 3 Others on 21 November, 2016

Taking away the list of judgments cited in this judgment from Hon’ble High Court of Allahabad, here is the judgment.

 

The facts would reveal that the second petitioner is aged about 32 years and the first petitioner is merely 18 years, second petitioner despite fully being aware that he has a living spouse, he duped the first petitioner and convinced her to elope with him under a false assurance of second marriage. Thereafter, the second petitioner had audacity to swear a false affidavit before the Court stating that this is his first marriage, thus, indulging in fraud and misrepresentation, both with the first petitioner and with the Constitutional Court. Such conduct cannot be ignored, law has to take its own course.

In regard thereto, false affidavit on oath has been filed by the second petitioner to misrepresent before the Court, which is wilful and deliberate, thus, exposing himself for prosecution under Section 193 IPC. No further enquiry or explanation is required.

Registrar General is directed to lodge a complaint before the competent Magistrate at Allahabad against the second
petitioner for filing false affidavit to mislead the Court. Second petitioner shall be taken into custody forthwith. The first petitioner being adult is let free.

Sanjeev Kumar Mittal Vs The State on 18 November, 2010

Citing many landmark Perjury precedents, Justice J.R.Midha of Delhi High Court has rendered this judgment. This CrPC 340 judgment is under Sections 193, 196, 199 and 200 of the Indian Penal Code. Since there was ample evidence for fraud on court, Police were directed to conduct preliminary inquiry.

Pritish Vs State Of Maharashtra & Ors on 21 November, 2001

The main contention point in this case in the Hon’ble Apex Court was “he was not heard during the preliminary inquiry conducted by the reference court under Section 340 of the Code.”

 

An exercise of the court at that stage is not for finding whether any offence was committed or who committed the same. The scope is confined to see whether the court could then decide on the materials available that the matter requires inquiry by a criminal court and that it is expedient in the interest of justice to have it inquired into.

Baban Singh And Anr Vs Jagdish Singh & Ors on 8 February, 1966

Hon’ble Apex Court here in this excellent judgment that,

 

Section 191 and 192 IPC deal with perjury and filing of false affidavit in pleadings would be covered under Section 191. Section 191 deals with evidence on oath and Section 192 with fabricating false affidavits; the offence under Section 191 IPC is constituted by swearing falsely when one is bound by oath to state the truth because a declaration made under an oath. The definition of the offence of giving false evidence thus applies to the affidavits.

The offence may also fall within Section 192 which, inter alia, lays down that a person is said to fabricate false evidence if he makes a document containing a false statement intending that such false statement may appear in evidence in a judicial proceeding and so appearing in evidence may cause any person who, in such proceedings is to form an opinion upon the evidence to entertain an erroneous opinion touching any point material to the result of such proceedings.

Therefore, where declarations in affidavits which were tendered in the Court to be taken into consideration, the authors of the affidavit clearly intended the statement to appear in evidence in a judicial proceedings and so appearing, to cause the Court to entertain an erroneous opinion regarding the compromise, therefore, the offence would fall within Section 191, 192 which is punishable under Section 193 IPC, therefore, it was held that the authors of the affidavits were guilty of offence of giving false evidence or fabricating false evidence for the purpose of being used in judicial proceedings.

Syed Nazim Husain Vs Additional Principal Judge Family Court & Anr on 9 January, 2003

Wonderful judgment from Bombay High Court setting aside judgments of 2 lower courts in regards to the maintainability of application under Section 340 of CrPC.

From Para 7,

Whenever an application under Section 340 of Code of Criminal Procedure is filed, the Civil Manual Chapter XIX para 337 requires that it should be registered as Miscellaneous Judicial Case i.e. a case where a Judicial Enquiry is contemplated. The learned Civil Judge should have, therefore, directed the application to be registered as Miscellaneous Judicial Case.

Sejalben Tejasbhai Chovatiya & vs State Of Gujarat on 20 October, 2016

Very nice judgment from High Court of Gujarat, wherein income (alimony given by Husband is income for tax purposes) hiding Knife is charged under sections 195 and 340 of CrPC.

 

Para 4,

The trial Court, on an application Exh.88 under sections 195 and 340 of the Code of Criminal Procedure preferred by respondent No.2 on 13.5.2016, recorded the evidence on both the sides and directed the Registrar of Family Court to file an application before the Pradyuman Nagar police station under sections 191,192 and 193 of the Indian Penal Code.

 

Para 8,

Learned advocate appearing for respondent No.2 has urged that it is very rare that the Court would go out of the way to hold that perjury has been committed and, in the instant case, it is quite obvious from the record that she had not revealed the fact that she is given permanent alimony of the sum of Rs.4,00,000/- so also all her income is shown under the Income-Tax Act.

 

Para 10,

Admittedly, this order has arisen on account of the affidavit given by the petitioner, wherein she declared herself a housewife having no source of income. However, she has admitted in her cross-examination that she has obtained Rs.4 lakhs from her previous husband at the time of taking divorce from him.

 

 

Para 16,

It also held that the bar would be attracted only when the offences enumerated in section 195(1)(b)(ii) have been committed with respect to a document, after it has been produced or given in evidence in a proceeding in any Court. If said offence is committed or given in evidence in Court, no complaint by Court would be necessary and a private complaint would be maintainable.

 

Para 18,

this Court has no reason to interfere as often it is found that the litigants coming before the Court chose to speak blatant lies and do so with complete impudence.

 

Para 19,

Laws which are otherwise in favour of the distressed wife when are sought to be misused by declaring completely incorrect facts and also by suppressing the material aspect, the trial Court at the time of considering the case found that the impact on the administration of justice would make it expedient for it to direct the prosecution.
