Bipin Shantilal Panchal Vs State of Gujarat and Anr on 22 February, 2001

In this landmark judgment, Supreme Court of India had formulated the following procedure while questions are put to witness during cross-examination. Also, per 138 Evidence Act, ‘Chief examination and cross-examination must relate to relevant facts, but cross-examination need not be confined to the facts to which the witness testified on his examination-in-chief.‘.

It has been held that, where admissibility of document is objected then the Court should tentatively mark the document as an exhibit and can determine the objections at the last stage in the final judgment. But, while holding so, the Apex Court carved an exception regarding admissibility of a document where objection is based on deficient stamp duty, then the Court has to decide the objection before proceeding further.
In this regard, reliance is placed upon the judgment of the Supreme Court reported in AIR 1966 SC 1631 for the proposition that no act of Court shall harm a litigant and it is the bounden duty of Court to see that if a person is harmed by a mistake of the Court, he should be restored to the position he would have occupied.

Jayeshbhai Khemchandbhai Patel Vs State of Gujarat on 17 March, 2017

The Rapist Jayesh Patel has prayed for a copy of the medical reports to be given to him under section 207 CrPC, which were purported to prove the crime of rape he committed. His prayer was denying by the Gujarat High Court stating that the accused will be entitled to such documents during the course of trial and may not be available at the current stage where he would like to file Discharge petition u/s 239 CrPC.

Hon’ble Supreme Court has passed directions in this Landmark order that are restricted only to the Bail proceedings under the NDPS Act. The directions pertain to below stages of the trial proceedings.

  1. Adjournments (4th proviso u/s 309 CrPC)
  2. Examination of witnesses (adopt the method of “session’s trials” and assign block dates for examination of witnesses)
  3. Workload of cases on Court
  4. Access to Narcotics laboratories
  5. Personnel
  6. Re-testing Provisions
  7. Monitoring of the NDPS cases
  8. Availability of Public Prosecutors
  9. Other recommendations: For the simplification of the above detailed process u/s 207 CrPC, we direct that the filing of the charge-sheet and supply of other documents must also be provided in electronic form.

In this case in front of Hon’ble High Court of Madras, it was held that “a Court of Law is to deliver a substantial Justice to the parties to secure the ends of Justice. A shortcut approach adopted by the trial Court resulting in dismissal of the complaint really would cause disaster effect on the complaint filed by the Appellant/Complainant.”

Meaning, instead of acquitting the accused based on attendance aspect by dismissing the complaint, the trial court magistrate must have proceeded further with case on merits.

Vimalben Ajitbhai Patel Vs Vatslabeen Ashokbhai Patel And others on 14 March, 2008

A landmark judgment from Hon’ble Apex Court which has seen many twists and turn of events spearheaded by the cunning knife who is an Advocate and filed a large number of cases against her husband and in-laws.

  1. Filing of false 498A in Ahmedabad, that got transferred to Baroda and later dismissed
  2. Another criminal proceeding against the appellants and their family members under Sections 323, 452, 427, 504, 506 and 114 of the Indian Penal Code, the same proceeding has also been dismissed as withdrawn.
  3. Another criminal case was initiated by her against appellant No.2, his son and another under Section 406, 420, 468 and 114 of the Indian Penal Code, which is still pending.
  4. Another case, being No.2338 of 2006 was filed by her under Section 500 of the Indian Penal Code.
  5. Another case under Section 406 of the Indian Penal Code being Case No.2145 of 1993 was filed against the appellants.
  6. Petitions filed for cancellation of bail granted to appellants, at magistrate, District and High Courts

At the end, the cunning foxy knife bit the dust and had to put her tail between her legs.


Another important aspect is the following from Para 24:

24. Section 4 provides for a non obstante clause. In terms of the said provision itself any obligation on the part of in-laws in terms of any text, rule or interpretation of Hindu Law or any custom or usage as part of law before the commencement of the Act, are no longer valid. In view of the non obstante clause contained in Section 4, the provisions of the Act alone are applicable. Sections 18 and 19 prescribe the statutory liabilities in regard to maintenance of wife by her husband and only on his death upon the father-in-law, Mother-in-law, thus, cannot be fastened with any legal liability to maintain her daughter-in-law from her own property or otherwise.
