7. Qualification of the wife and the capacity to earn cannot be a ground to deny interim maintenance to a wife who is dependant and does not have any source of income.

The converse is read like this:

Wife who is independant and have source of income, can be a ground to deny interim maintenance to a wife.

Subhash Bahadur @Upender Vs State (NCT of Delhi) on 6 Nov 2020

Delhi High Court held that there is no need for filing an formal application seeking default bail, once the conditions set out in section 167(2)(a) are made out, as continued confinement violates fundamental right under Article 21.

From Paras 32, 33 and 34,

32. A plain reading of the Proviso (a) to Section 167(2) of the Cr.PC indicates that an accused would necessarily have to be released on bail “if he is prepared to and does furnish bail”. Thus, in cases where the statutory period of sixty days or ninety days has expired, the accused would be entitled to be released on bail provided he meets the condition as set out therein – that is, he is prepared to furnish and does furnish bail. It is important to note that there is no provision requiring him to make any formal application.

33. It is also trite law that there is no inherent power in a court to remand an accused to custody. Such power must be traced to an express provision of law [See: Natbar Parida Bisnu Charan vs State of Orissa: (1975) Supp SCR 137 and Union of India vs Thamsharasi: (1995) 4 SCC 190]. As is apparent from the language of Proviso (a) to Section 167(2) of the Cr.PC, the power of a Court to remand an accused to custody pending investigation is circumscribed and stands denuded if the period of sixty days or ninety days, as the case may be, has expired and the accused is ready and willing to furnish bail.

34. It is also necessary to bear in mind that courts have consistently leaned to resolve the tension between form and substance, in favour of substance and have used the interpretative tools to address the substance of the matter. In Ajay Hasia Etc v Khalid Mujib Sehravardi & Ors:1981SCR(2) 79 had, in an altogether different context, observed that “where the constitution fundamentals vital to maintenance of human rights are at stake, functional realism and not facial cosmetics must be the diagnostic tool, for constitutional law must seek the substance and not the form”. Thus, if in substance the essential conditions as set out under the Proviso (a) to Section 167(2) of the Cr.PC are met and complied with – that is (i) if the investigation has not been completed within the period of sixty or ninety days, as the case may be, from the date of arrest of the accused; and (ii) if the accused is prepared to offer bail – then there would be no justifiable reason to detain the accused.

71. In view of above facts discussed, the settled law is that if the prosecution witnesses presumed to be true, without any cross examination, still conviction cannot be awarded to the accused, then deserves for discharge, as the case in hand is.

Deepti Kapur Vs Kunal Julka on 30 June 2020

In this case, Single Judge discussed the admissibility of evidence in cases filed in Family Courts u/s 14 and also dispelled the false notion that if a spouse obtains an evidence illegally (by installing a CCTV in this case), such act would not be violative of the other spouse’s right to privacy. And also nothing in Constitution of India prohibits such evidence.

From Para 37,

37. While consistency in law is of utmost importance and law must get its full play regardless of the fact situation, this court must record the unease it feels with regard to a certain aspect that has arisen in this matter. Marriage is a relationship to which sanctity is still attached in our society. Merely because rules of evidence favour a liberal approach for admitting evidence in court in aid of dispensation of justice, this should not be taken as approval for everyone to adopt any illegal means to collect evidence, especially in relationships of confidence such as marriage. If the right to adduce evidence collected by surreptitious means in a marital or family relationship is available without any qualification or consequences, it could potentially create havoc in people’s personal and family lives and thereby in the society at large. For instance, if a spouse has the carte blanche to install a recording device in a bedroom or other private space or to adopt any means whatsoever to collect evidence against the partner, even if in circumstances of matrimonial discord, it would be difficult to foresee the length to which a spouse may go in doing so ; and such possibility would itself spell the end of the marital relationship. It is not uncommon for spouses to continue living together, even in matrimonial strife, for years on-end. So, while law must trump sentiment, a salutary rule of evidence or a beneficent statutory provision, must not be taken as a license for illegal collection of evidence.

Yashpal Kumar Vs Bhola Nath Khanna and Anr on 1 March 2012

This is a Delhi High Court judgment where a certain conclusion is made without basis. Just an earlier judgment is cited as support even that one lacks justification. Funny.

From Para 8,

8. It is thus evident that Section 7 (3) is a non obstante clause and will thus prevail on any other law for the time being in force and a statement made by a person aggrieved by the offence under this Act shall not subject him to prosecution under this Act. Thus the decision of this Court in Neera Singh (supra) is an obiter and does not constitute a binding precedent for the reasons that the provisions of DP Act 1961 were not subject matter of the dispute before the Court in the petition under Section 482 Cr.P.C. in Neera Singh’s case and thus, this Court did not take into consideration the provisions under Section 7 (3) of the DP Act.

From Para 9,

9. Further there is no merit in the contention of learned counsel for the Respondent that the Petitioner being the father of the victim girl was not an
“aggrieved person”. Section 7(3) of the DP Act bars cognizance of a complaint against the person aggrieved by the offence. It cannot be said that only “aggrieved person” would be the victim girl. Even the father of the victim girl, who was made to give dowry, would be an aggrieved person. Similar view has been taken in Ram Gopal Sah v. State of Jharkhand, II (2009) DMC 844.

No one explains how/why should the Dowry giving criminals (as per Sec 3(1) should be protected from prosecution along with their daughter, who can be considered an aggrieved person!!!
