The Supreme Court referred a matter in Krishna Veni Nagam Vs Harish Nagam on 9 March, 2017 here, to larger bench, to adjudicate if video conferencing should be used in deciding a transfer petition in a matrimonial case. The final judgement is here.

My First Moot – 1st GITAM Regional Moot Court Competition 2019

It was just one day before the last date of paying the registration fee and submitting participant details to the organizers, that I came to know about a Moot Court Competition being conducted at GITAM School of Law, Vishakapatnam. I would have not taken interest in it if not for the Moot problem said 498A IPC and 304B IPC !!!

As someone fighting couple of false matrimonial cases (1. Sec 498A IPC and Sec 3,4 of DP Act 2. Sec 12 of PWDV Act) on his own as Party-in-Person to protect his elderly parents who are falsely implicated in this motivated cases, saying Yes to this competition, was my instant reaction. This is one golden opportunity for me to hear and more importantly, see young law students argue a case, which is of total interest to me personally, for above mentioned reasons. I was confident to win the competition, irrespective of competition’s strength.

The Beginning

Now, I need to find my team mates and I had no ready options. Learned faculty put together the team and I got a team on the last date of registration. Phew!!

The research for the Memorials arguments began and daily brainstorming of all possible argument points shared on Whatsapp. Evening face-2-face meetups to revisit the argument points and put text around the thoughts/ideas. That was exhausting and sometimes irritating, but really fruitful. Got Memorial copies from Library of our previous batch participants. They had participated in the Prelim and did not move forward. Their personal experiences were quite helpful in preparing ourselves for this Moot.

It was a first time learning experience on how a Moot Competition runs at Regional level. I am done with Moot Competitions, at Regional level. And may be one National level Moot Competition. Just may be. Check out learning experiences and Identified improvement areas here.

Do you know how to misinterpret laws? Don’t know? Learn from this judgment from Delhi High Court.

From Paras 12-16,

12. Second proviso to sub section (1) to Section 125 Cr.P.C. stipulates grant of interim maintenance. Reading of second proviso does not in any manner indicate that making of an application seeking interim maintenance is a pre-condition for grant of interim maintenance.

13. The Third proviso to sub section (1) to Section 125 Cr.P.C. stipulates disposal of an application for grant of interim maintenance within a time bound manner.

14. If the second and third proviso to sub section (1) to Section 125 Cr.P.C are read keeping in view the very object of the statute, it shows that there is no requirement stipulated by the statute for making an application for grant of interim maintenance pending consideration of the petition under section 125 Cr.P.C. and the Court would be empowered to pass an order assessing interim maintenance even in a case where no such application has been filed by the person claiming maintenance. However, where such an application is made, the same would have to be disposed of by the Trial Court within the time stipulated therein.

15. If a narrower interpretation were to be given to the provision i.e. that an application is a pre-condition for grant of interim maintenance, the same would militate against the very object of the scheme of providing maintenance to a dependant, who is unable to maintain himself/herself, where the person who has sufficient means has refused or neglected to maintain the dependant. 16. Keeping in view the beneficial object of the statute, it is held that the filing of an application seeking interim maintenance would not be a precondition for grant of interim maintenance pending consideration of the petition seeking maintenance under section 125 Cr.P.C.. It would be open to the trial court to grant interim maintenance, in the facts and circumstances of the case, pending consideration of the application for grant of maintenance under section 125 Cr.P.C.
